{"id":2182,"date":"2006-04-26T21:39:25","date_gmt":"2006-04-27T02:39:25","guid":{"rendered":"https:\/\/www.wrestlingpod.com\/wrestling-news\/w2182\/"},"modified":"2006-04-26T21:39:25","modified_gmt":"2006-04-27T02:39:25","slug":"virginia-tech-issues-statement-re-transfer-status-of-wrestlers","status":"publish","type":"post","link":"https:\/\/www.wrestlingpod.com\/wrestling-news\/w2182\/virginia-tech-issues-statement-re-transfer-status-of-wrestlers\/","title":{"rendered":"Virginia Tech Issues Statement RE Transfer Status of Wrestlers"},"content":{"rendered":"<p><font size=\"2 \"face=\"Arial \"color=\"#000000\"><\/font><font size=\"2\">Bryan Johnston Virginia Tech<\/font><\/p>\n<p>Due to numerous requests concerning the eligibility status of<br \/>\nVirginia Tech wrestlers, the Virginia Tech Athletics Department<br \/>\nissues the following statement:<\/p>\n<p>&#8220;The Virginia Tech Athletics Department has chosen not to release for the 2006-07 academic year any National Letter of Intent (NLI) signee or those wrestlers receiving athletics financial aid to any<br \/>\nDivision-I institution.<\/p>\n<p>The National Collegiate Athletics Association (NCAA) sets forth<br \/>\nguidelines pertaining to transfer situations amongst its member<br \/>\ninstitutions. The NCAA has had a transfer rule in place throughout<br \/>\nits years. The NCAA transfer rules require the permission of the<br \/>\ninstitution in order for the student-athlete to avoid eligibility<br \/>\nconsequences.<\/p>\n<p>The rule was enacted, in large part, and remains in place to this<br \/>\nday, in order to control the unfettered transfer of athletes from one<br \/>\nteam to another due to a coaching change. Virginia Tech will apply<br \/>\nthis rule for the purpose that it was intended.<\/p>\n<p>The Virginia Tech Athletics Department has informed these athletes that it will provide transfer releases following the 2006-07 academic year if a student-athlete still wishes to transfer out of Virginia Tech.<\/p>\n<p>Virginia Tech announces its position, aware that its decision is<br \/>\nsubject, per NCAA rules, to an appeal hearing conducted by a<br \/>\ncommittee of Virginia Tech faculty and staff that reside outside of<br \/>\nthe athletics department.&#8221;<\/p>\n<p>In releasing this statement, the Virginia Tech Athletics Department<br \/>\nwill have no further comments until the process has run its full<br \/>\ncourse.<\/p>\n<p>Attached for your reference are the relevant NCAA transfer bylaws.<\/p>\n<p>Relevant NCAA Bylaws<br \/>\nConcerning &#8220;Permission to Contact &#8220;. . .<\/p>\n<p>NCAA Bylaw 13.1.1.3<br \/>\n&#8220;An athletics staff member or other representative of the<br \/>\ninstitution&#8217;s athletics interests shall not make contact with the<br \/>\nstudent-athlete of another NCAA or NAIA four-year collegiate<br \/>\ninstitution, directly or indirectly, without first obtaining the<br \/>\nwritten permission of the first institution&#8217;s athletics director (or<br \/>\nan athletics administrator designated by the athletics director) to<br \/>\ndo so, regardless of who makes the initial contact. If permission is<br \/>\nnot granted, the second institution shall not encourage the transfer<br \/>\nand the institution shall not provide athletically related financial<br \/>\nassistance to the student-athlete until the student-athlete has<br \/>\nattended the second institution for one academic year. If permission is granted to contact the student-athlete, all applicable NCAA recruiting rules apply.&#8221;<\/p>\n<p>NCAA Bylaw 13.1.1.3.1<br \/>\n&#8220;If the institution decides to deny a student-athlete&#8217;s request to<br \/>\npermit any other institution to contact the student-athlete about<br \/>\ntransferring, the institution shall inform the student-athlete in<br \/>\nwriting that he or she, upon request, shall be provided a hearing<br \/>\nconducted by an institutional entity or committee outside of the<br \/>\nathletics department (e.g., the office of student affairs; office of<br \/>\nthe dean of students; or a committee composed of the faculty<br \/>\nathletics representative, student-athletes and nonathletics<br \/>\nfaculty\/staff members). The institution shall have established<br \/>\nreasonable procedures for promptly hearing such a request.&#8221;<\/p>\n<p>Concerning the One-Time Transfer Exception (&#8220;Release&#8221;) . . .<\/p>\n<p>NCAA Bylaw 14.5.5.1<br \/>\n&#8220;A transfer student from a four-year institution shall not be<br \/>\neligible for intercollegiate competition at a member institution<br \/>\nuntil the student has fulfilled a residence requirement of one full<br \/>\nacademic year (two full semesters or three full quarters) at the<br \/>\ncertifying institution.&#8221;<\/p>\n<p>NCAA Bylaw 14.5.5.2.10-(d)<br \/>\n&#8220;If the student is transferring from a NCAA or NAIA member<br \/>\ninstitution, the student&#8217;s previous institution shall certify in<br \/>\nwriting that it has no objection to the student&#8217;s being granted an<br \/>\nexception to the transfer-residence requirement. If the student&#8217;s<br \/>\nprevious institution denies his or her request for the release, the<br \/>\ninstitution shall inform the student-athlete in writing that he or<br \/>\nshe, upon request, shall be provided a hearing conducted by an<br \/>\ninstitutional entity or committee outside of the athletics department<br \/>\n(e.g., the office of student affairs; office of the dean of students;<br \/>\nor a committee composed of the faculty athletics representative,<br \/>\nstudent-athletes and nonathletics faculty\/staff members).
